In a landmark ruling on May 15, 2026, the Texas Supreme Court held that “passive shippers” that hire federally regulated, independent motor carriers to transport goods do not owe a legal duty of care to the motoring public for the actions of the carrier’s driver when the shipper neither controls the carrier’s operations nor creates risk by virtue of the loading or nature of the cargo.
