Ohio’s most recent challenge to the medical malpractice damages caps has found footing in the Tenth District Court of Appeals. In a unanimous decision, the Court held that Revised Code 2323.43, Ohio’s statute capping non-economic damages in medical claims, is unconstitutional as applied to the plaintiff in Lyon v.
